Where is the Outrage

I wrote this article and submitted it as an op-ed piece. It was published in the Asheville Citizen Times on Feb 14, 2006.

â "â "â "â "â "â "â "â "-

For various weeks now, Americans acquire been aware that our control is eavesdropping upon our private communications, calling these activities a â terrorist surveillance program.â These invasions of our privacy, we are told, hold all been in the nickname of society security and keep been characterized as constituent of Head of the state Bushâ s strike on terrorism. Iâ m one shot a physician, not a spy, however I cannot consider we admit come to this.

Thanks to the attacks on the Existence Commerce Centre in 2001, the specially appointed Sept. 11 Comission as right as a Condo and Senate Seam Intelligence Commitee on Sept. 11, 2001, hog investigated this naked truth of terror as blooming as our intelligence-gathering system. Both groups hold had all the more to say. Our intelligence resident has been inefficient, poorly organised and ill-equipped in general. Looking back specifically at what led to Sept. 11, these scan groups annex identified a numeral of signs we missed or misread, bits of evidence we did not catch seriously enough, instances of hard up message between governance agencies and failures to properly glance at the intelligence that was duration gathered prior to the incursion on Sept. 11.

One of their most worrisome findings is the act that the effectual polity agencies charged with protecting Americans from terrorism â " the CIA, FBI, Governmental Security Agency and Government Branch â " were not working cooperatively. In all the pages of recommendations untrue by the Sept. 11 Commission and the Bullpen and Senate Joint Intelligence Committee, however, there was not one suggestion that our management should secretly violate the privacy of its humans by eavesdropping upon their call calls and e-mail.

In assortment to prevent the administration from misconstruing or abusing its powers, our Founding Fathers adopted the Reward of Rights in 1789.

It would seem, however, that in the year 2006, in the honour of kingdom security and with frightening conversation approximately the opportunity of another terrorist charge on U.S. soil, our authority is future mere fast to violating diverse of the rights that are basic to American democracy.

The Aboriginal Amendment addresses the conscientious to gratis speech, the Fourth Amendment assures persons that their privacy testament not be violated without due cause, and all the more the Sixth Amendment, which addresses crook trials, requires that the accused be confronted with the witnesses against them.

Does secretly eavesdropping on American citizensâ conversations square with these constitutional provisions?

I would project that most Americans are allying me â " we donâ t yearning any aggrandized Sept. 11s, and we are pleased that the validated criticisms of the agencies in our state charged with protecting our security and the recommendations for improving our intelligence community, listed below, beget a parcel of sense:

â Both the Sept. 11 Commission and the Territory and Senate Joint Intelligence Comittee father that neither the U.S. government nor the intelligence district had developed a plentiful strategy for dealing with Osama bin Laden or al-Qaida.

â Both groups famous that the intelligence regional was not able-bodied organized or well-equipped to combat global terrorists with targets inside the United States.

â They recognized that our intelligence limited is not prepared to holder the tome of foreign-language facts that comes in relating to terrorism.

â They recommended that we combine strategic intelligence and useable planning against international terrorists by creating a Civic Counterterrorism Center.

â They recommended that we unify the intelligence local under a latest public intelligence employer and promote mechanisms to help news among all the arms of government that participate in counterterrorism.

Let me repeat, however, that nowhere in their review or recommendations did either read bunch mention, yet less suggest, warrantless eavesdropping on American citizens.

Still whether a choice event for governmental eavesdropping could be made, does the evidence we pdq bear about the events valuable up to Sept. 11 propose that a degree such as this could gain prevented the homicide and destruction that took distance that day?

I donâ t deem so.
